Exclusive RE Leads: First Call on TREC’s HOA Addendum
For exclusive real-estate leads in HOA subdivisions, use TREC 36-11’s Subdivision Information checkboxes on the first call. Keep automotive enquiries on competing offers.
The short answer
Exclusive real-estate seller leads in HOA subdivisions stall when nobody owns the Subdivision Information task. TREC’s Addendum for Property Subject to Mandatory Membership in a Property Owners Association (36-11) (replaces 36-10; form date 05-04-2026) spells out who obtains the restrictions/bylaws/resale certificate packet under Property Code §207.003, the buyer’s 3-day termination window after delivery, and the transfer-fee cap in Paragraph C. TX Lead Forge’s real-estate leads are exclusive; automotive seller enquiries remain competing offers—never exclusive to one dealer—see /automotive-leads.
First-call script points (from the opened form)
Confirm property type. Mandatory HOA membership and not a condominium (condos use a different resale-certificate path).
Name the association and phone on the addendum line—do not leave it blank.
Pick Subdivision Information ownership early. Seller-paid delivery, buyer-paid delivery, already-approved, or buyer declines—only one box.
Explain the 3-day clock. If information is delivered under boxes 1–2, the buyer may terminate within 3 days after receipt (or prior to closing, whichever first) with earnest money refunded.
Cap transfer fees in Paragraph C. Buyer pays association transfer charges up to the negotiated maximum; seller pays excess.
Material-change duty. If dues, litigation, or assessments shift after delivery, the seller must notify promptly.
Ops notes for exclusive RE desks
Order association docs the same day the exclusive lead assigns a listing path—do not wait until option-period panic.
Train ISAs to ask “HOA or condo?” before quoting a generic disclosure checklist.
Storm weeks still spike exclusive roofing leads; keep those on the roofing first-call track (after-storm roofing) and do not mix scripts.
Automotive seller enquiries: competing offers among dealers—never pitch them as exclusive to one rooftop.
Pair with listing prep questions
On the first exclusive-RE call, ask only what the addendum needs:
Is membership in a property owners association mandatory?
Is the property a condo (different form path) or a subdivision HOA?
Who usually orders the resale certificate here—seller, buyer, or title?
Any known special assessments, lawsuits, or right-of-first-refusal language the association mentions up front?
Those answers tell your agent which Paragraph A box to recommend. They also prevent the lead from going cold while someone “looks up the HOA later.”
Keep product lines clean
TX Lead Forge serves businesses seeking leads. Reminder for Monday handoffs:
Roofing and real-estate leads are exclusive.
Automotive seller enquiries use competing offers—dealers are never told a seller enquiry is exclusive to them.
Invalid-lead issues stay case by case—no invented refund language on the call.
If a storm weekend floods both roofing and seller-auto phones, staff two queues. Do not read the HOA addendum script to a car seller, and do not read a competing-offer appraisal pitch into an exclusive listing lead.
What this post is not promising
No invented close rates, refund policies, or “guaranteed listing” language.
TREC forms educate the conversation; brokers and agents remain responsible for current promulgated forms.
Invalid-lead issues are handled case by case—we do not invent credit/replacement policies.
Exclusive applies to roofing and real-estate products as confirmed; auto stays competing.
Bottom line
Exclusive East Texas RE leads in HOA neighborhoods need a 36-11-aware first call: who pulls Subdivision Information, who pays, and how transfer fees are capped. Keep auto seller traffic on the competing-offers desk.
